Terms of Service

Welcome to BetterLink. These Terms of Service ("Terms") govern your access to and use of the BetterLink website and services. By creating an account or using our services, you agree to be bound by these Terms. If you do not agree, please do not use BetterLink.

1. About BetterLink

BetterLink ("we," "us," or "our") provides affiliate link management tools including automatic localization across Amazon storefronts and mobile deep linking to help affiliate marketers maximize their commissions.

2. Eligibility

You must be at least 18 years old to use BetterLink. By creating an account, you represent and warrant that you are at least 18 years of age and have the legal capacity to enter into these Terms. If you are using BetterLink on behalf of a business or organization, you represent that you have the authority to bind that entity to these Terms.

3. Account Registration

To use BetterLink, you must create an account. You agree to provide accurate, current, and complete information during registration and to keep your account information updated. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. Accounts are for individual use only and may not be shared with others. You must notify us immediately if you suspect unauthorized access to your account.

4. Subscription and Billing

Pricing

BetterLink offers a subscription-based service. Current pricing is available on our pricing page. Pricing may include a base subscription fee, usage-based fees for clicks exceeding your plan's allocation, and optional add-ons such as custom domains. We reserve the right to change our pricing with notice to existing subscribers.

Billing Cycle

Subscriptions are billed monthly on the anniversary of your subscription start date. Usage-based charges (such as click overages) are calculated and billed at the end of each billing period.

Payment

You authorize us to charge your payment method for all fees incurred. If payment fails, we may suspend your access to the service until payment is received. You are responsible for any taxes applicable to your subscription.

Cancellation

You may cancel your subscription at any time through your account settings or by contacting us. Upon cancellation, you remain responsible for any charges incurred up to the cancellation date. Your links will continue to function until the end of your current billing period, after which they will redirect to their original Amazon URLs without localization or deep linking.

No Refunds

Subscription fees and usage charges are non-refundable. We do not provide refunds or credits for partial months, unused features, or periods when your account was inactive.

5. Acceptable Use

You agree to use BetterLink only for lawful purposes and in compliance with these Terms. You may not:

  • Use the service to violate any applicable law or regulation
  • Create links that redirect to illegal, fraudulent, or harmful content
  • Attempt to circumvent usage limits, billing, or security measures
  • Use automated means to access the service in a manner that exceeds reasonable use
  • Resell, sublicense, or provide the service to third parties without authorization
  • Interfere with or disrupt the service or servers connected to it
  • Reverse engineer, decompile, or attempt to extract source code from the service

6. Amazon Associates Compliance

BetterLink is designed to work with the Amazon Associates Program. You are solely responsible for your compliance with Amazon's Operating Agreement and any other terms governing your participation in the Amazon Associates Program. This includes proper disclosure of affiliate relationships on your website or content. BetterLink is not affiliated with or endorsed by Amazon. We do not guarantee acceptance into the Amazon Associates Program or continued eligibility. If Amazon terminates your affiliate account or changes their program terms, you remain responsible for compliance.

7. Intellectual Property

Our Property

BetterLink, including our website, software, logos, and documentation, is owned by us and protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable license to use the service for its intended purpose during your subscription.

Your Content

You retain ownership of the content you provide to BetterLink, such as link notes and affiliate tags. By using the service, you grant us a license to use this content as necessary to provide the service to you.

Feedback

If you provide us with suggestions, ideas, or feedback about the service, you grant us the right to use and incorporate such feedback without any obligation to you.

8. Third-Party Services

BetterLink integrates with and relies on third-party services to operate. These include payment processors, infrastructure providers, and Amazon's services. Your use of these services is subject to their respective terms and privacy policies. We are not responsible for the availability, accuracy, or conduct of any third-party services. When visitors click your BetterLinks, they are redirected to Amazon, and Amazon's terms and privacy policy apply to their experience on Amazon's website or app.

9. Disclaimer of Warranties

BETTERLINK IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT ANY DEFECTS WILL BE CORRECTED. WE DO NOT GUARANTEE ANY SPECIFIC RESULTS FROM USING THE SERVICE, INCLUDING AFFILIATE COMMISSIONS OR CONVERSION RATES.

10. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, BETTERLINK AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, REVENUE, DATA, OR BUSINESS OPPORTUNITIES, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM THESE TERMS OR YOUR USE OF THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

11. Indemnification

You agree to indemnify, defend, and hold harmless BetterLink and its affiliates, officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the service, your violation of these Terms, your violation of any third-party rights (including Amazon's terms), or your content.

12. Termination

We may suspend or terminate your account at any time for any reason, including if we reasonably believe you have violated these Terms. Upon termination, your right to use the service ceases immediately. You may also delete your account at any time through your account settings. Sections of these Terms that by their nature should survive termination (such as limitation of liability and indemnification) shall survive.

13. Changes to These Terms

We may modify these Terms at any time. We will notify you of material changes by updating the "Last updated" date at the top of this page. For significant changes, we may also notify you by email. Your continued use of the service after changes take effect constitutes acceptance of the modified Terms. If you do not agree to the changes, you must stop using the service and cancel your subscription.

14. Governing Law & Disputes

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware and the United States, without regard to conflict of law principles. Any disputes arising from these Terms or your use of the service shall be subject to the exclusive jurisdiction of the state and federal courts located in the State of Delaware.

15. Severability

If any provision of these Terms is found to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect.

16. Entire Agreement

These Terms, together with our Privacy Policy and Cookie Policy, constitute the entire agreement between you and BetterLink regarding your use of the service and supersede any prior agreements.
